Assessments

A District has a duty to assess students in all suspected disabilities prior to the IEP meeting for the current school year. If the District has not conducted a proper assessment prior to the IEP, then as a consequence there was no scientific data at the IEP meeting to offer adequate special education services in all areas of need. Hence, this was not sufficient to constitute a FAPE.
